The Facility Fees imposed and collected by the District pursuant to the Facility Fee Resolution are pledged to pay debt service on the Series 2004 Bonds. The Facility Fee Resolution establishes a Facility Fee for the services and facilities the District provides or causes to be provided, inclusive of the costs associated with the construction, installation, operation and maintenance of the Facilities.

The Facility Fee Resolution imposes a one-time residential  Facility Fee for residential dwelling units that are to be constructed within the boundaries of the District. The Facility Fee imposed by the resolution is $1,914 for single-family residential dwelling units and $1,172 for multi-family residential dwelling units. However, any residential dwelling unit that is exempt or otherwise subject to or has already paid  a substantially similar impact fee imposed by El Paso County shall not be subject to the District’s residential Facility Fee.

The residential Facility Fee must be paid at, or prior to, and as a condition of El Paso County granting a building permit for all residential dwelling units in the District. In addition, the Facility Fee Resolution imposes a one-time commercial and non-residential Facility Fee for commercial and non-residential buildings that are to be constructed within the boundaries  of the District.

The non-residential Facility Fee is based on the gross building square foot or room, as may be the case. The calculation of the non-residential Facility Fee is based upon $1.50 per square foot for industrial and agricultural land uses, $200 per room  for lodging land users, and $2.00 per square foot for recreational, institutional, medical, office, retail and service land uses, all as defined by the Institute of Transportation Engineers Trip Generation Manual, 6th Edition.

The commercial and non-residential Facility Fee must be paid at, or prior to, and as a condition of El Paso County issuing a building permit. Pursuant to the Intergovernmental Agreement, El Paso County has agreed to require proof of payment of the District-imposed Facility Fees from any in District building permit applicant.

All the Facility Fees established under the Facility Fee Resolution are due and payable to the District. Until such fees are paid, the residential Facility Fees and commercial and non-residential Facility Fees constitute a perpetual lien on and against such property in the District. Pursuant to the Indenture, the District will agree to promptly collect all Facility Fees imposed by it and take all action available to enforce any lien against property within its boundaries for unpaid Facility Fees. See Appendix A – The Indenture. As set forth by Appendix E, the District expects to receive $3,842,514 in Facility Fees.
